Terms of Use for Instant HDR

1. What Instant HDR does

Instant HDR allows users to select a photo from their device, convert it into an HDR JPEG, and save the converted file back to the device's photo library.

Free exports may include a watermark. A paid subscription removes the watermark from exported HDR JPEG files.

2. Eligibility

You must use the Service in compliance with applicable law and these Terms. If you are using the Service on behalf of another person or entity, you represent that you are authorized to do so.

3. Subscription and billing

Instant HDR may offer an auto-renewable subscription through Apple's App Store.

If you purchase a subscription:

• payment is charged through your Apple ID account
• subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
• account renewal charges are handled by Apple
• you can manage or cancel your subscription in your Apple account settings

We do not receive your full payment card information.

4. Free and paid features

The free version of Instant HDR may include watermarking on exported images.

The paid subscription removes the watermark from exported HDR JPEG exports. We may update, modify, or discontinue features at any time, including free or paid features, provided such changes comply with applicable law.

5. User content

You retain ownership of the images you select, process, or export using Instant HDR.

You are solely responsible for ensuring that you have the necessary rights to use, edit, export, post, or distribute your images.

We do not claim ownership of your photos.

6. Acceptable use

You agree not to:

• use the Service in violation of any law or third-party rights
• interfere with or disrupt the Service
• attempt to reverse engineer, copy, scrape, or misuse the Service beyond what is permitted by law
• use the Service to process or distribute unlawful, infringing, abusive, or harmful content

7. No guarantee of third-party platform behavior

Instant HDR is designed to help users create HDR JPEG files for posting workflows, including Instagram-related workflows. However, third-party platforms may change their processing, rendering, compression, metadata handling, or display behavior at any time.

We do not guarantee how any third-party platform will display, transform, compress, or otherwise handle exported files after upload or posting.

8. Service availability

We may change, suspend, or discontinue all or part of the Service at any time, with or without notice.

We do not guarantee uninterrupted availability or error-free operation.

9. Disclaimer

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will meet your expectations or achieve any particular result.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the Service.

Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid, if any, for the Service in the 12 months before the claim arose.

11. Termination

We may suspend or terminate access to the Service if you violate these Terms or misuse the Service.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version on this page and update the effective date above.
